Terms & Conditions for Myna App

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Myna App ("the Service") operated by MYNAA Financial Solutions Pvt. Ltd. ("us", "we", or "our").

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

1. Definitions

• Account: A unique account created for you to access our Service.
• Company: MYNAA Financial Solutions Pvt. Ltd., located at Hamirpur -210301 UP India.
• Service: The financial investment service provided by the Myna App.
• Terms and Conditions: These Terms and Conditions that form the entire agreement between you and the Company regarding the use of the Service.
• Third-party Social Media Service: Any third-party service or content (including data, information, products or services) that may be displayed, included or made available by the Service.
• You: The individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

2. Eligibility

To use the Service, you must be at least 18 years of age and have the legal capacity to enter into a contract under Indian laws. By using our Service, you affirm that you meet these conditions.

3. Account Registration and Security

• When you create an account with us, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.
• You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
• It is mandatory to complete the KYC (Know Your Customer) process for account registration, which includes verification of Aadhaar Card, PAN Card, and bank account details, as mandated by Indian regulatory bodies.

You acknowledge and agree that:

• The rate of return mentioned (e.g., 5-15% monthly) is indicative and based on historical performance, not guaranteed. Actual returns may vary based on market conditions and investment strategies.
• You should consult a qualified financial advisor before making any investment decisions.
• MYNAA is a technology platform facilitating investments and operates under applicable Indian regulations.

5. Services Provided

The Myna App provides the following services:

• Investment Services: Facilitating users to make monthly investments in Indian equities, mutual funds, and other regulated financial instruments.
• Premium Services: Additional features including advanced analytics, personalized financial advisory, priority customer support, and exclusive investment opportunities.

6. Fees and Payments

• All applicable fees for our services, including premium subscription fees and transaction charges, are clearly stated on our website and app.
• You agree to make payments through secure payment gateways like Razorpay. You acknowledge that we do not directly store your credit card or bank login information; this information is processed directly by our payment processor (Razorpay).
• You are responsible for all applicable taxes and charges.

7. User Conduct and Obligations

• You agree to use the Service only for lawful purposes and in accordance with these Terms and all applicable laws and regulations.
• You will not engage in any activity that interferes with or disrupts the operation of the Service.
• You will not attempt to gain unauthorized access to or interfere with any part of the Service.

8. Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of MYNAA Financial Solutions Pvt. Ltd. and its licensors. The Service is protected by copyright, trademark, and other laws of both the India and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of MYNAA Financial Solutions Pvt. Ltd.

9. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

10. Limitation of Liability

In no event shall MYNAA Financial Solutions Pvt. Ltd., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

You agree to defend, indemnify and hold harmless MYNAA Financial Solutions Pvt. Ltd. and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms; or c) Content posted on the Service.

12. Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute relating to the breach of these Terms shall be exclusively subject to the jurisdiction of the courts located in Hamirpur, Uttar Pradesh, India.

13. Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service.

14. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a "material change" will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
